REAL ESTATE PHOTOGRAPHY SERVICES AGREEMENT Gold Coast Property Staging
Thank you for choosing Gold Coast Property Staging ("Photographer," "We," "Us," "Our") for your real estate photography needs. This Services Agreement ("Agreement") outlines the terms and conditions applicable to the services provided to you ("Client," "You," "Your"). By booking our services, you agree to these terms.
Booking and Payment
Payment Due: Full payment is required before the delivery of the final edited photographs ("Photos"). Payment Methods: We accept Cash, Bank Transfer, (payable to "Gold Coast Property Staging"), Visa, Mastercard, American Express, and Discover.
Secure Online Payment: Payment can be conveniently made online via a secure and encrypted portal at the time of booking, or in person at the time of the photoshoot.
2. Photo Delivery
Timeline: We are committed to delivering Photos in 3 to 5 business days following the photoshoot. Delivery will be made via a Google Drive link sent to your nominated email address. * Delays: While we strive to meet this timeline, unforeseen circumstances (e.g., technical issues, server outages beyond our reasonable control) may occasionally cause delays. We will communicate any such delays promptly.
Third-Party Uploads: We do not upload Photos directly to third-party websites.
3. Image Format and Quality
Format & Resolution: Photos will be delivered in JPEG format, or other standard digital formats, at a resolution deemed suitable by the Photographer for their intended use in real estate marketing.
4. Client Review: It is the Client’s responsibility to verify the suitability of the Photos (including format, resolution, and content) within five (5) business days of delivery. Notification of any perceived unsuitability must be made to the Photographer in writing within this period.
5. Photographer’s Obligation: The Photographer’s sole obligation for Photos deemed unsuitable will be to make reasonable efforts to replace the specific Photos with a version at a suitable resolution or with corrections. The Photographer shall not be liable for poor reproduction quality due to Client-side issues, delays in Client review, or any consequential damages arising from the use of the Photos.
6. On-Site Operations
Property Preparation: The Client is responsible for ensuring the property is clean, decluttered, and photo-ready at the scheduled shoot time. The Photographer is not responsible for staging* (*where the only service paid for is photography not the staging), cleaning, or moving items. A property that is not ready may impact the quality of the photos or the ability to capture all desired areas.
7. Scheduled Time and Property Access: If the Photographer arrives at the property at the scheduled time and is unable to gain access (e.g., no key in lockbox, no one present as arranged), we will make reasonable attempts to contact the Client. If the photoshoot cannot proceed and must be abandoned due to lack of access, the 50.00 aud non-refundable booking fee will be used to cover the photographer’s time and efforts. The Client may reschedule the shoot, which will be treated as a new booking and will incur a new 50.00 aud booking fee.
8. Inclement Weather & Hazardous Conditions: The Photographer reserves the right to postpone or reschedule a photoshoot due to inclement weather (e.g., heavy rain, thunderstorms, high winds) or other hazardous conditions that may compromise safety or image quality.
The Client may request to reschedule due to weather conditions by contacting the Photographer at least one (1) hour prior to the scheduled shoot time, without penalty. If the Client elects to proceed with the photoshoot despite unfavourable conditions acknowledged by both parties, the Client accepts the risk of potentially compromised image quality (e.g., grey skies, inability to capture exterior shots or specific features) or the omission of certain services (e.g., external photography). Should a return trip be necessary to complete aspects of the photoshoot impacted by a Client's decision to proceed in unfavorable conditions, or for reasons not attributable to the Photographer, additional fees may apply (e.g., travel fee, pro-rated service fee).
9. Photographer Safety: The safety of our photographers is paramount. If, at any time, the Photographer feels unsafe, threatened, or encounters a hazardous environment on-site, they reserve the right to terminate the photoshoot and leave the premises immediately, regardless of the progress made. The 50.00 aud non-refundable booking fee will be used to cover the cancellation, and the Photographer reserves the right to decline future services or rescheduling.
10. Image Selection and Special Requests Photographer's Discretion: A comprehensive number of images will be captured during the photoshoot. The final selection of images delivered to the Client as part of the pre-priced package is at the sole artistic and professional discretion of the Photographer. Special Requests: The Client may request specific shots or areas to be photographed in advance of the shoot (e.g., community amenities like pools, clubhouses, parks, signage). The Client is responsible for ensuring access to these areas is arranged and permissible.
11. Intellectual Property and Licensing Copyright Ownership: Gold Coast Property Staging retains full copyright ownership and all intellectual property rights for all Photos,and other materials produced or created by us. Usage License Granted to Agent: The Client (Agent/Brokerage) is granted a non-exclusive, non-transferable license to use the delivered Photos for all marketing activities directly related to the sale of the specific property photographed. * Photographer's Promotional Use: Gold Coast Property Staging reserves the right to use any Photos for its own promotional purposes, including but not limited to inclusion in online portfolios, websites, social media, and other advertising materials.
12. Cancellations, Rescheduling, and Refunds Cancellations/Rescheduling by Client: More than 24 hours notice: Services may be cancelled or rescheduled without penalty if notice is provided to Gold Coast Property Staging more than 24 hours prior to the scheduled appointment time. Less than 24 hours notice: The $50.00 non-refundable booking fee will be used to cover cancellations or rescheduling requests made with less than 24 hours notice prior to the scheduled appointment time. Refunds: Payments for services rendered are non-refundable. No refunds are provided for cancellations; applicable fees as stated above will apply. Credits for future services may be considered at the sole discretion of Gold Coast Property Staging.
13. Disclaimer of Warranties with Respect to Website Use The Gold Coast Property Staging website and online booking platform ("Website") are provided on an “AS IS” and “AS AVAILABLE” basis. EXCEPT AS SPECIFICALLY PROVIDED HEREIN, TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, Gold Coast Property Staging EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, RELATING TO THE WEBSITE, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Gold Coast Property Staging DOES NOT MAKE ANY WARRANTY THAT THE WEBSITE WILL MEET YOUR REQUIREMENTS, OR THAT ACCESS TO THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED. Gold Coast Property Staging MAKES NO WARRANTIES AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE WEBSITE OR AS TO THE ACCURACY, QUALITY, OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE WEBSITE. YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE WEBSITE IS USED AT YOUR OWN RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA.
14. Limitation of Liability To the maximum extent permitted by law, the total liability of Gold Coast Property Staging, its employees, and contractors, for any claim arising out of or relating to the services provided or this Agreement, whether in contract, tort, or otherwise, shall be limited to the total fees paid by the Client to Gold Coast Property Staging for the specific services giving rise to the claim. In no event shall Gold Coast Property Staging be liable for any indirect, punitive, special, incidental, or consequential damages (including loss of business, revenue, profits, use, data, or other economic advantage).
15. Acceptance of Terms * By proceeding with a booking for services with Gold Coast Property Staging, the Client acknowledges they have read, understood, and agree to be bound by these Terms of Service and Cancellation Policy.
